This website (“pzo.info”) is operated by PZO and its affiliates (collectively, “us”, “we”, or “the Organization”). Your access and use of our website at pzo.info or by subscribing to the community mailing list, community forum or any forms of syndications of content on this site (RSS, and ATOM feeds) signify that you have read, understand, and agreed to be bound by these Terms of Use and our Privacy Policy whether or not you are a community member. We reserve the right, at our sole discretion, to modify, change, add, or delete, all or portions of these Terms of Service without further notice. All changes to these Terms of Use will be posted to this page and a date will be included on the bottom indicating the last date these terms were revised. Your continued use of this website after any such changes constitutes your acceptance of the new Terms of Use. Eligibility

Membership in the community is not necessary, but you have to be of the Zoroastrian faith for accessing and using this Website. This site in intended solely for users who are thirteen years of age or older, and any use of or accessing this Website by anyone under thirteen, is unauthorized, unlicensed and in violation of these Terms of Use. By accessing and using this Website you represent and warrant that you are thirteen or older, and that you agree to abide by all the terms and conditions of this Agreement.

All content on this site and available through syndication, including designs, text, graphics, pictures, video, information, applications, and other files, and their selection and arrangement (the “Website Content”), are the proprietary of the Organization, and licensors with all rights reserved. No Website Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any forms by any means, in whole or in part, without the Organization’s prior written permission. Provided that you are eligible for use of the Site, you are granted a limited license to access and use this website and the Website Content and to download or print a copy of any portions of the Website Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. User Conduct

This Website is for your educational, and informational purposes only. You agree not to use this Website to:

• use this Website by any unlawful manner or any other manner that could damage, disable, overburden or impair this Website;
• use automated scripts to collect information from or otherwise interact with the Website;
• solicit any information for any person;
• post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence;
• post copyrighted content without written permission of the author or publisher;
• do anything unlawful, misleading, malicious, or discriminatory;
• facilitate or encourage any violations of this Statement;

Registration and Account Security

Registration in PZO website is not required. However, users have to register to receive certain benefits such as posting in the forums, updating their contact information and marketing preferences, and use PZO Mart. Thus, we collect real names and information and we need your help to keep it that way. By registering in this site you agree to the following:

• You will not provide any false personal information on PZO website, or create an account for anyone other than yourself without permission;
• You will not register if you are under 13;
• You will keep your contact information accurate and up-to-date;
• You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account;
• You will not transfer you account to anyone;

Protecting Other People's Rights

We respect other people's rights and we expect you to do the same. By using this site you abide to the following rules:

•  You will not post content or take any action on PZO Website that infringes someone else's rights or otherwise violates the law;
• We can remove any content you post on this site if we believe that it violates this Statement;
• If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate;
• You will not post anyone's identification documents or sensitive financial information on this site.        

The Information We Collect

The information we collect are two types: personal information, forum entries, or articles that are willingly posted by you, and the information we collect as you interact with the site such as statistics, and conversion rates.

When you register in PZO, you provide us with certain personal information such as you name, your email address, your telephone number, your address, your gender, your birth date and any other personal or preference information that you provide to us. Your mailing address and phone will not be published but other information such as your photo avatar, the city you live in, the number of posts you have made in the forums or other statistics from forum and your username will be viewable by other registered users.

When you enter PZO site, we collect your browser type and IP address. This information is gathered for all PZO site visitors. In addition we store certain information from your browser using "cookies." A cookis is a piece of data stored on the user's computer tied to tinformation about the user. We use session ID cookie to confirm that users are logged in. These cookies are terminated once the user closes the browser. By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to loging when you come back to PZO Site. You can remove or block this cookie using the setting in your browser if you want to disable this convenienve feature.  

When use PZO website, you may setup your personal profile in the forum or the community, perform searches and quesries, post content in the forums, comment on photos in the gallery through various channels.

You post user concent at your own risk. We only limit posting of content to the registered users and filter displaying some personal informations to the pblic, however, anybody visiting the website, or any unregistered user, may have access to some or all if this information, but the posting of content is only limited to the registered users in the community. We cannot control the actions of all the users, and please understand that no security measures are perfect or impenetrable. Therefore we cannot guarantee that the content your will post will not be used by unauthorized people.We are not responsible for circumvention of any privacy setting or security measure contained on the Site.

Any improper collection or misuse of information provided on PZO Website is the violation of this Terms of Service and Privacy Policy.

Payments

When you make payments through PZO for services like purchasing merchandise from PZO Mart, making a donation, or register for a paid event, you agree to these payment terms:

1. Making Purchases
   1. When you conform a transaction on PZO, you agree to be bound by an pay for that transaction;
   2. Pay attention to the details of the transaction, because your total price may include taxes, fees, and shipping costs, which you are responsible for paying;
   3. Don't commit to a transaction unless you are ready to pay, because all sales are final;
   4. If you order something that becomes unavailable before it can be provided to you, your only remedy is to receive a refund of your purchase price;
   5. You may be presented with additional terms related to a specific purchase before you confirm the transaction (such as shipping terms for tangible goods). Those additional terms will also govern that transaction;
   6. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD ON OR THROUGH PZO.
2. Payment Sources

   We want to make payments convenient, so we allow you to make payments using a number of different payment sources, like credit cards and debit cards by PayPal. Please make sure you read PayPal's privacy policy:

   1. When you provide a payment source to us, you confirm that you are permitted to use that payment source. You also authorize us to collect and store it, along with other related transaction information;
   2. When you make a payment, you authorize us (and our designated payment processor) to charge the full amount to the payment source you designate for the transaction;
   3. If you pay by credit or debit card we may obtain a pre-approval from the issuer of the card for an amount up to the amount of the purchase. We will bill your card at the time of purchase or shortly thereafter. If you cancel a transaction before completion, that pre-approval may result in your funds not otherwise being immediately available;
   4. If you pay by debit card and your payment results in an overdraft or other fee from your bank, you alone are responsible for that fee.
3. Actions We May Take

   As part of our effort to keep PZO safe, we may take certain actions to reduce liability for users and us.

   1. We may make any inquiries that we consider necessary, either directly or through third parties, concerning your identity and creditworthiness.
   2. We may cancel any transaction if we believe the transaction violates these Payments Terms or the Statement of Rights and Responsibilities, or we believe doing so may prevent financial loss.
   3. We may place a delay on a payment for a period of time, limit payment sources for a transaction, limit your ability to make a payment or deactivate your account if we believe doing so may prevent financial loss.
   4. We may contact your payment source issuer, law enforcement, or impacted third parties (including other users) and share details of any payments you are associated with if we believe doing so may prevent financial loss or a violation of law.
   5. We may cancel any credits transferred, assigned, or sold in violation of these Payments Terms or the Statement of Rights and Responsibilities.
   6. If you purchase advertising, and your payment method fails or your account is past due, we may take steps to collect past due amounts using other collection mechanisms. You agree to pay all expenses associated with such collection, including reasonable attorneys' fees. Interest will accrue on any past due amounts at the rate of the lesser of 1% per month or the lawful maximum.
4. Disputes and Reversals
   1. If you believe that an unauthorized or otherwise problematic transaction has taken place under your account, you agree to notify us immediately, so that we may take action to prevent financial loss.
   2. To the fullest extent permitted by law, you waive all claims against us related to payments unless you submit the claim to us within 30 days after the charge.
   3. You are responsible for and agree to reimburse us for all reversals, charge-backs, claims, fees, fines, penalties and other liability incurred by us (including costs and related expenses) that were caused by or arising out of payments that you authorized or accepted.
   4. We may intervene in disputes between users concerning payments but have no obligation to do so.
   5. Your only remedy for a technical failure or interruption of service is to request that your transaction be completed at a later time.

We encourage our usersto be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Terms and Privacy statement applies solely to information we collect on this site.  

Changing or Removing Information

Access and control over most personal information on PZO website is readily available through profile editing tools in the community and forum. PZO users may modify or edit any profile information at any time by logging into their account. Other information such as forum posts and galley comments may be deleted or modifies by the user, however we do not let users to modify images in the gallery.

PZO reserves the right to remove or alter ay information entered by the users to its site with our without reason at any time.

Security

PZO takes appropriate precautions to protects our users' information. Your account information is located on a secured server. When you enter sensative information (such as your credit card number or password), we encrypt that information using secure socket layer technology (SSL). None of the other information posted in the forums or gallery are treated this way, so we ask you to never share any personal information in those areas.

Termination

If you violate the letter or spirit of this Statement, or otherwise create possible legal exposure for us, we can stop providing all or part of services through PZO Site or PZO as the organizaztion to you. We will generally try to notify you, but have no obligation to do so. When the services get terminated, we just disable you account, but all your forum posts, gallery comments and other information you shared on the site remain there.

How to Report Claims of Intellectual Property Infrigement

PZO complies with the Digital Millennium Copyright Act (17 U.S.C. § 512), also known as the DMCA. The DMCA provides a simple procedure for copyright owners to report content that infringes their copyrights. Please be aware that the DMCA makes copyright owners liable if they materially misrepresent that a user's content is infringing.

Disputes

1. You will resolve any claim, cause of action or dispute ("claim") you have with us arising out of or relating to this Statement or PZO in a state or federal court located in Santa Clara County. The laws of the State of California will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Santa Clara County, California for the purpose of litigating all such claims.
2. If anyone brings a claim against us related to your actions or your content on PZO, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
3. WE TRY TO KEEP PZO SITE UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING PZO SITE "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT PZO SITE WILL BE SAFE OR SECURE. PZO IS NOT RESPONSIBLE FOR THE ACTIONS OR CONTENT OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT OR PZO WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
